I think it would be, too--but did you see the caption that says Hot Brown, above.--and the photo is of a fish dish (the hot brown is lower down)...the copy editor didn't come from KY.

for what it's worth ...

by RebeccaWebb » Tue Mar 27, 2007 10:59 pm

copy of article removed ....

does this mean we can't put the reviews by Marty et al on here either?

If anyone wishes to read this great article about Kentucky and some of our well-known chefs, then they can go to the original link in the first message and register (for free) to read it.

Since the article is copyrighted, one should not post the entire article without permission. Giving author and source is not adequate--you need permission.

I understand what you believe, but what are the legal issues/facts here?

And, Rebecca, thanks for the article. It was a totally great read and so positive about the Ville and Kentucky as well.

I just posted the link to the original message. From that site:
Myth #5: It’s okay to use anything as long as I give credit

No. For copyright law, the question is whether you have permission. If you don’t have permission, you’re infringing.

Hey, I'm over in Italy, too far away to do anything about it. ;)

Okay, bottom line, it's best not to quote copyright material in full, and I would prefer not to see us make a habit of it. But since forum posts are so much like conversation ("Hey, see this article in the CJ?") that I'm not too inclined to get worked up over the occasional "post-on-request" like this.

If we start doing it wholesale, though, I'll issue a gentle reminder that it's better as a rule to quote the first few paragraphs, and then summarize or link to the rest.

Thanks to Rebecca for posting it here. I won't remove it.

Do a Google search on "internet message board copyrighted material" and you will see that most forums have rules against this practice because it is a violation of copyright.

Again, attribution is not enough: permission must be granted for posting an entire article. Robin is trying to be kind, but he'll get bitten by this eventually--it's his responsibility because he hosts the forum. Larger internet forums have been bitten by it, and that's why they have the rules.

Here's a good quotation from the Sierra Club website:
The Sierra Club cannot advise Chat/Message Board participants with respect to compliance with intellectual property and other laws. However, we ask you to be aware of the following -- it is a commonly held but very mistaken belief that materials posted on the Internet are automatically in the public domain. This is not correct. Except for official government documents, virtually all works of original authorship are protected by copyright regardless of the manner of publication or distribution, including online. Except under very limited circumstances constituting "fair use," you must get the copyright owner's permission before reproducing all or part of a copyrighted work.

At least the Tiger lady and the Hon. One-Call don't claim, like the ubiquitous trio does, that Hospital Curve is called that because of all the accidents!!!!!
