Im not aware that this was allowed after 1 pm. I have never seen someone leave with half a bottle of wine from a restaurant. I am sure it has happened but its legality would be in question.

It's legal as long as it sealed. Some local restaurants even have special bags they will put the bottle in and then seal it. We've actually used one at Selenas.
