How would you deal with this septic company?

We are just a small family restaurant and recently pissed off by a local septic company. We used this company to clean the inside grease trap since 2010. Every 3 months or so we called in the service & told them to be at the restaurant at least one hour before we open for business. Last August the hauler came around 11:20am which was 10 minutes before we open and we told him that he can’t pump that day and to come by another day because the grease smell may spread into the dining area. Few days later, a MSD inspector came by gave us a violation notice that we refused to pumpout. Since then we switch to another septic company. On 25th of Feb around 3:30pm, the hauler with the old septic company suddenly came & told us we were on 3month schedule. We told him the grease trap was already cleaned by another company a month ago & perhaps we did not call in for the service. Then the hauler asked us to sign the refusal paper & we did not sign it. A week later got a certified letter from MSD and saying that we are on second violation offense etc. then our landlord called us blah blah blah & cause he got a copy of violation letter from MSD too. Immediately we wrote a respond letter to MSD with the document that the grease trap was already cleaned and now waiting for how MSD respond us. We are very mad the way the old septic company handle the business like this, not calls to us to confirm the time & then reported to MSD that we refused for pumpouts. Our question is what if the old hauler comes again next time & how should we deal with them? Thank you for reading the long story & Advises welcomed.

Did you sign a contract with the old company that put you on a 3 month clean-out schedule or were you on a call-as-needed basis?

Do you have documentation from the new company that asserts that your trap has, in fact, been cleaned? Presenting said documentation should make the landlord and MSD go away.

As for the old company, I would call them and inform them that you are discontinuing the use of their services and that they are to no longer send service trucks to your address. I wouldn't sign anything from them apart from a dissolution of services agreement.

Before anything else, I'd send the old hauler a registered letter stating that you do not wish them to clean your grease trap, that you had never signed up for a 3-month contract, and that if you had signed up by copy of this letter you are cancelling. State that if there were any problem with this to contact you by letter and telephone (giving a number). Save a copy of the letter and the receipt.

Then, if you have a friend who is an attorney show him/her the letter and ask if there is anything else you should do.

thank you all for the advises! we did not sign any contracts with the old company and basically just called in as every 3 months or so. I think we should send a certified letter asking them to stop to come :x
