Papa Johns faces 250 Million Dollar Lawsuit

by Steve P » Tue Nov 13, 2012 11:35 pm

This chucklehead won't raise the price of his pizza 14 cents in order to provide health insurance for his employees...but I'll bet ya something nice he'll raise the price to cover THIS tab.

http://money.cnn.com/2012/11/13/technol ... ?hpt=hp_t3

Popular U.S. pizza chain Papa John's faces a $250 million class-action lawsuit for blasting customers with illegal text messages.

The plaintiffs allege that Papa John's (PZZA) franchises sent customers a total of 500,000 unwanted messages in early 2010. The spam texts offered deals for pizza, and some customers complained they were getting 15 or 16 texts in a row, even during the middle of the night, according Donald Heyrich, an attorney representing the class.

I almost never text. I hate texting. So, I have a cellphone program where I pay for each text I send and receive up to a certain number. 20 or so unsolicited texts!? I'd be livid! I hate this new attitude of un-asked for intrusion and thinking its OK.
Steve P I bet you are right on the money if this lawsuits succeeds!

Here's a detailed story in Nation's Restaurant News:
http://nrn.com/article/papa-johns-hit-2 ... c4enews=42

I really do think Papa stuck his foot in it with his injudicious comments about Obamacare. It's one of those defining statements that makes people ask, "Do I want to buy a pizza from this man?" Frankly, I was more inclined toward Coals or Papalinos from the get-go, but this puts the icing on the cake for me. #PapaFAIL.

Eh, I don't know, I guess I don't really tend to hold people's politics against them when considering their products. Roger Baylor's political screeds don't make his beer less tasty or make me less likely to drink it, and Schnatter's hamhanded approach to Obamacare doesn't make me less likely to buy his pizza.

I don't either unless they are throwing it in your face like Schnatter and obviously being a political sore-loser at the expense of his employees health. I read it would cost 14 cents per pizza or 8-10 million a year for the company to provide the health care. They made $55 million net income last year. Don't tell me they couldn't work it out, cut come costs (uh, don't run 500 million ads with Peyton Manning on Sundays), raise prices a little and have little net effect on net income or sales.

I mean regardless of how he decides to run his business, how big of an idiot do you have to be to go public with this thinking you will get sympathy. Just keep your mouth shut and run the business.

What gets me about Schnatter is how hypocritical he seems in light of the fact that non-customers are subsidizing his business to a large degree. If he doesn't offer health insurance to his employees, taxpayers are paying for it, because I highly doubt if any of those employees can afford their own health policies.
In the same vein, who's paying to insure all of his delivery drivers? Not Papa John's. Those drivers (and by default the rest of policy holders) are paying for that insurance. And a few years ago, PJs switched from paying drivers minimum wage to a tip credit system similar to how servers are paid, so when they're on the road they make less than half the minimum wage. That delivery charge? it goes to the store, not the driver.

Whoa ... it's getting uglier, according to Business First:

If I could...I'd order pizza from this guy. Every night.

http://www.huffingtonpost.com/2012/11/1 ... 33050.html

..."Papa John's CEO John Schnatter’s recent statement that the Affordable Care Act will force the pizza chain to raise prices came as good news to Nick Martin.

Martin, a part owner of Ian’s Pizza, a pizza shop with four locations in Wisconsin, said his business has offered full heath care coverage to its 50 full-time employees for years, making it all the more difficult to compete with national chains like Papa John's that pay workers low wages without health benefits"...

Good for him. He's a real job creator unlike Schnatter who seems to be more of a hoarder.

I think John needs to hire a new PR director. Everything he says is being twisted and used against him by the political left.... who are also pizza consumers. Although he may have a fair point that there's no such thing as a free lunch, I gather some of his main shareholders don't care to see him become a lightning rod for political issues
