Blackstone Grill being sued

Interesting. I know there have been cases where restaurants and bars have been sued for serving intoxicated patrons, but I've never heard of a place being sued for not preventing an employee from driving.Any thoughts on this?

Anybody can sue anyone for anything, the issue is whether it stands up to a Motion to Dismiss. Nothing there that says they served him alcohol. http://www.lrc.ky.gov/KRS/413-00/241.PDF Absent the creation of an affirmative duty to prevent someone from driving drunk, there should be no liability,

I have heard of people suing a restaurant they worked at because they had too many shift beers and drove and got a dui.

And it is not surprising AT ALL Falling Rock Quarry is getting sued. Anyone who spent 10 minutes there the past few summers could tell you this place was a lawsuit waiting to happen.

Since I'm not good at law, I was curious if anyone knew about cases such as this. The story from the media was that this fellow showed up too drunk to work and they told him to go home. DUH! IMO, he should have been fired, but whatever. There is no proof that somebody suggested that he not drive, or that someone offered to take him home or call a cab, etc as far as I know. I guess it's like a medical malpractice suit where they sue everyone including the janitor who cleaned the ER room.

Does this mean that they have to pay an attorney to represent them? THAT stinks!

Yeah it does stink. Hopefully their insurance will kick in, but in the long run and short run they pay: Deductibles, higher rates, lost revenue, time dealing with it all and bad press. Huge stinko. Might be time for the Hotbytes crew to show a little love.
