Love their Ice Cream, not so into them trademarking ubiquitous concepts.

Brown Foreman holds the right to name the "Official Bourbon". Used to be Old Forester and now they use it to promote Woodford Reserve (because they make a lot more off Woodford) but you can use any of their bourbons in making official Derby products. I think they still use Old Forester in making the cheapo Mint Juleps they sell at the track. (FYI, Woodford Reserve is actually "select" barrels of Old Forester blended with the pot stilled bourbon they make in Woodford County. Those stills can't make enough to meet demand).
So don't slam a local business for teaming with a local icon to promote a local event and a local product all of which are unquestionably high quality. Also, Churchill Downs has every right to protect their brand, as do the companies who pay big money to use it.
Pay up or shut up.
BTW, Derby Ice Cream is ****ing TASTY. Go get some. Just sayin...
