NIce PR trick- it was on NPR yesterday. Personally, I see no point to eating food too hot to taste.

not into the whole machismo it's so hot i'm such a hard ass thing. if it adds to the flavor, fine. anything more is just swordsmanship.

It's a matter of taste. I personally love extra heat, and don't think it's my machismo talking. I hardly ever get dishes as spicy as I want them when that's what I'm in the mood for. I'd happily sign a waver. I used to work for Furlongs on Frankfort, and the chef kept a bottle of liquid fire in the kitchen. I had a customer request the bottle or a ramekin of it to heat his jambalaya up to his preference, but the chef denied it. I understood the chef's position of liability, but...

This sounds like a gimmick.

But, heat is good!

Heat should add flavor of the dish, so I'm agin' capsicum extracts. That's just not good eats. Bring on all the natural hot peppers and sauces. I'll eat 'em if they taste good. There's no need to make a show of it.

I did meet my match at Edward Lee's Inferno Dinner a few years ago. One of the side dishes was a Bhut Jolokia, that seemed to have been smoked like a chipotle. I only ate half of that. I wish he'd melded it into a dish instead. Oh well.
