I was downtown at Permitting and Licensing on some unrelated business and I got into a discussion with a city rep about the vagaries of the mobile food truck ordinances.
She informed me the city council is working on a new ordinance that would require food trucks to obtain vendor permits vs. the current hodgepodge system of rules (14 day temps, vs fixed location licensing on private property, vs all the gray ways people are currently operating).
So as this is a Jefferson County/Louisville Metro issue the first tact would be to contact your city councilperson and begin lobbying them.
I would expect the ordinance to be written and discussed by the council throughout the autumn.

So if the 14-day rule is in fact a state regulation, as has been indicated here, seems like this revised local ordinance would not take its place. Ergo, not only would food truckers have to obtain the new permit, they'd STILL have to comply with the 14-day rule?

The grey ways people have been operating were OKed in essence by the Mayors office until they got the permitting structure worked out. These problems are only around because there are 2 conflicting permits and it apparently went unnoticed for a few years. Another reason why there havent been food trucks around sooner.

The new IPL permit for mobile food vendors will not change anything about the states health department rules. Which laws you are subject to are based on which agency gets the complaint or which one shows up. We are trying to talk to the Mayors office now to see about getting the health department permits changed so that it will work in conjuction with the IPL permit instead of against it.

We are aware of the new permit and it was supposed to be rolled out this month but apparently they are still hashing out details.

Getting state stuff changed isnt nearly as easy as it was to get an amendment to a local city ordinance.

We will still have to be permitted by both the health department AND the IPL and their permits still directly conflict each other. The only real change in the IPL permit, that I know of, is that we can move around every day and submit our route information every 2 weeks.

What happens if a B&M decides to open up within the 100-foot zone of your previously approved location? Do you get bumped?
