Unfortunately, I'm just a young, non-laywer person with some long term hearing damage from being exposed to the same volume of noise and not knowing enough then to know what it would do. I've never made a penny of that, nor would I attempt to, as I've typically found suing people to be pointless. Contrary to what you take from my comments, I do what you say: I go away and don't go back, and recommend to the restaurant owners they fix it.

But restaurants are getting in trouble for this outside Louisville (including, yes, lawsuits from former staff), and Louisville restaurants are eventually going to have the hammer come down on them, too, if we ever become as big of a city as we hope.
To be clear, as snarky as you may want to be, we have restaurants here who are flat breaking the law. I'm not going to report them -- I instead usually tell the owner and find they're generally unaware that their restaurant is _that_ loud or know it and know itt is exceedingly expensive to fix it. In some cases, they're already working on it. But eventually OSHA will bring the hammer down on them as they've started to do in New York. You can do the "Just go away!" bit, but it doesn't change the fact that restaurants run under most of the same laws as the rest of us.

And, as a former restaurant worker, most beginning restaurant workers don't have the option to "just go away." Nor do they likely realize that, as per a restaurant whom I intentionally did not name (though it has been discussed in detail here, but as they said they were fixing it, I'm giving them a pass), there are restaurants in Louisville where working for 3 hours _causes hearing damage_. Again, snark if you want, but snark doesn't really tend to protect people when an actual health issue comes to the forefront, and this has become a topic de jure in many forums.

I would think that OSHA rules are OSHA rules and by ignoring them restaurants are putting themselves at risk. We also have health regulations and no one says, "If you don't want to eat in a dirty restaurant -don't go there."
