I can't absolutely say they're not. This conversation took place in the semi-public realm of Facebook, and Tim might have been glossing over that detail. I'm not saying he was, but it's certainly possible. ;)

Over the years Kern's has staunchly defended their trademark, which is of course, what the trademark owner must do to protect their trademark. Do you remember when they sued Bon Appetit magazine a couple of decades ago when B.A. purportedly published the recipe for Derby Pie (r)? Kern's won.

I like Pie Kitchen's Kentucky Bourbon Walnut Pie (or whatever the name is) better than Kern's Derby Pie. Also, they still have the Derby Pie ice cream at Sister Bean's on New Cut Rd. in their ice cream freezer last I checked.
