Appeals court rules on wine shipments

Kentucky officials will be required to allow out-of-state wineries to ship their product to consumers in Kentucky who order wine on the Internet or by phone, according to the U.S. 6th Circuit Court of Appeals.

The court, which oversees Kentucky, Ohio, Michigan and Tennessee, upheld a 2006 ruling by Judge Charles R. Simpson III of the U.S. District Court in Louisville that ruled that Kentucky’s ban on out-of-state wine shipments is illegal, according to a court document.

According to the appeals court ruling, which follows several similar rulings in courts in Michigan and Texas, Kentucky’s requirement that wine be purchased in-person is a violation of the interstate commerce clause of the Constitution.

In October, a federal court in Michigan had ruled that consumers in that state also have the right to buy wine shipped to them from out-of-state retailers.

That court also ruled that the commerce clause of the U.S. Constitution prohibits blocking out-of-state retailers from selling, delivering and shipping wine directly to consumers.

So, as I understand it, the shipping allowance is for wineries producing under 50,000 gallons per year. I don't have a good sense for what wineries that may include and exclude. Robin? Any generalities?

I haven't read the case, TP, but I don't THINK that's right. It may be the kind of artificial separation that the Supremes threw out in Granholm, the major case that triggered all this activity.

But, um, 50,000? Simplest way is to say that few if any "artisan" wineries make that much, but all the industrial wineries do. Gallo and Kendall-Jackson would be out. Laurel Glen and Spottswood would be in.

We definitely need more G4 on this, though, but bottom line, it looks awfully good unless the wholesaler lobby can get to our legislature next time and simply bar shipping by all, which would basically put the tiny but growing Kentucky wineries out of business.

I thought I heard that the state of KY had designed some onerous registration system for wineries that wanted to ship here. Even if the higher court upheld the shipping rule, many small wineries - those producing less than the 50k gallons TP references - wouldn't bother with the application process considering the relatively small sales expected in KY. :?:

(Regardless, I am happy the Court so ruled)

I think you are right, Robin, that the 50,000 limit was overturned. It does appear,though, that they kept the two-case limit for shipments. Not a huge hurdle for most of us!

I love wine, but being a beer guy, I wonder if this applies to beer as well. There are many beers that I can't buy here in the Commonwealth, but would love to have shipped to me. Anyone know if beer is part of this? Or, is it all alcohol?

I have to admit, I've been off the forum a couple days....and so when I saw this header, I said "Whoa!" THEN I said "WOO-HOO!"

Now if anyone has any trouble ordering a full case from their favorite winery, and needs some other folks to go in with them, Tom and I are usually willing volunteers.......:-)
