Attention food truck vendors

by Pat Costas » Thu Aug 04, 2011 9:07 pm

Hey food truckies. We need to put our heads together in regards to the health department 14 day regulation. In my humble opinion the duties oft the department of health is to protect the health and welfare of the community it serves. I believe they do a decent job of it also. However someone on the state level decided that Mobil units need to move every 14 days and be gone for thirty days before returning. How is that ordinance protecting the health and welfare of the community? Somehow that rule needs to be changed as the only thing it does is hurt the small business owner. Any feedback is appreciated

The idea is that it's supposed to protect brick and mortar establishments from a truck setting up shop in front of or near them, while they're paying rent, for their building. Blah blah.

That being said, it makes sense, but I don't think the food truck community is that thoughtless. I don't see any of the vendors that are currently running stepping on another businesses toes in that way. Las Gorditas had a good thing because there's hardly any food out in that area and the places out there weren't ones it was competing with.

The rules are definitely antiquated and could stand for a good redo.

What changes to the current rules do you or the other truckers suggest?

This same protection could be established with a much better rule such as one that prevented them from setting up within a certain distance from a business they would be competing with. You'd also think that kind of protection would more likely come from local government than state gov't. It probably was developed over 100 years ago for a reason that doesn't even exist anymore.

The rule does not offer protection for brick and mortar establishments. It allows a food truck to set up 14 days with owner of property permission of course. Then 30 days later you can set up again for 14 days? How is that protecting the brick and mortar. If an established restaurant didn't want the competition of a food truck they could very simply let the owner of the property know that they don't want us there and wa la no permission to set up, problem sovled. In our situation we pay rent for a little piece of asphalt whethewr we are there or not. Bottom line is the fourteen day rule needs to be stricken from the books. I just have no clue as to how to go about getting it changed,

Hmmmm....

It is almost sounding like folks are asking for less government regulation.

Interesting.

Pat, one good place to start working within the system would be to find out who is the state rep and state senator from your district - they guy you vote for - and also the state legislators for the Eastland Plaza, if that's different, and try to get a little face time to present your case and ask if they're willing to participate in an effort to get the state law changed. If one or more of them is amenable, then you've got a foothold.

At that point, I'd consider simple community organizing. If the legislative guys will introduce a bill, then start a petition at Las Gorditas. We'll help beat the drum here on HotBytes, and you'll probably want to set up a "Free the Louisville Food Trucks" page on Facebook. We can help you with that, too.

But since this is a legislative matter, I'd strongly suggest that you begin by talking to the legislative guys. Most of them are happy, even eager, to work with constituents, and as long as your request doesn't run counter to their favorite contributing lobbyists, you'll be launched on the long road toward change.

Interesting.

I think we're looking for better regulation. Not anarchy, but the application of common sense to the legislative process.

A hefty contribution to an influential State legislator surely will help.

This sounds more like a city ordinance issue. Has anybody confirmed it's a state regulation going on a wild goose chase?

The Facebook page shows 3pm - 1am for Friday hours. I'm assuming since they were in the spot in front of the Cox's Smokers Outlet location last night when I nabbed dinner there, they should be there again tonight.
